DweLL In is a real estate advisory and information platform. We are NOT property developers, builders, or sellers. All properties showcased are owned by third-party developers.

1. Acceptance of Terms

By accessing the DweLL In platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.

2. Platform Services

2.1 Services Provided

DweLL In provides:

•Information about real estate projects and curated home listings across multiple markets
•Advisory services for property search and evaluation
•Facilitation of virtual tours, brochure downloads, and property inquiries
•Cross-border advisory for India-Dubai investments
•RERA compliance verification and builder credibility information

2.2 Services NOT Provided

DweLL In does NOT:

✗Own, develop, construct, or sell any properties listed on our platform
✗Guarantee property availability, pricing, or specifications
✗Provide legal, tax, or financial advisory services (consult licensed professionals)
✗Enter into sale agreements on behalf of developers or buyers
✗Guarantee investment returns or property appreciation

3. User Responsibilities

3.1 Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our services. By using our platform, you represent and warrant that you meet these requirements.

3.2 Account Security

If you create an account, you agree to:

•Provide accurate and complete information
•Maintain the confidentiality of your login credentials
•Notify us immediately of any unauthorized access
•Accept responsibility for all activities under your account

3.3 Prohibited Activities

You agree NOT to:

✗Use the platform for any illegal or unauthorized purpose
✗Scrape, copy, or reproduce content without written permission
✗Interfere with or disrupt the platform's functionality
✗Impersonate any person or entity
✗Transmit viruses, malware, or harmful code
✗Use automated systems (bots, crawlers) without authorization
✗Harass, threaten, or abuse our staff or other users

4. Property Information Disclaimer

All property information, images, renderings, floor plans, specifications, prices, and availability displayed on our platform are provided by third-party developers and are subject to change without notice.

You acknowledge and agree that:

•Property images and renderings are artistic representations and may differ from actual construction
•Specifications, amenities, and features are indicative and subject to developer modifications
•Prices displayed are approximate and may change based on floor, unit, payment plans, and promotions
•Possession timelines are estimates provided by developers and may be subject to delays
•RERA registration, approval status, and compliance information should be independently verified
•DweLL In makes no warranties regarding accuracy, completeness, or reliability of information

You must conduct your own due diligence, site visits, legal verification, and consult with licensed professionals before making any investment decisions.

5. Intellectual Property Rights

All content on the DweLL In platform, including text, graphics, logos, images, videos, software, and design elements, is the property of DweLL In or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes only. You may not:

✗Reproduce, distribute, or publicly display our content without written permission
✗Modify, adapt, or create derivative works from our content
✗Use our trademarks, logos, or branding without authorization
✗Frame or link to our content in a misleading manner

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

•DweLL In provides the platform and information "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
•We disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and accuracy
•We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform
•We are not responsible for losses resulting from property transactions, developer defaults, construction delays, or market fluctuations
•We are not liable for third-party content, links, services, or actions of developers/builders
•Our total liability to you for any claim shall not exceed the fees you paid to us (if any) in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless DweLL In, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

•Your use or misuse of the platform
•Your violation of these Terms of Use
•Your violation of any rights of third parties
•Your property transactions or disputes with developers
•Any information or content you submit to the platform

8. Termination

We reserve the right to suspend or terminate your access to the platform at any time, with or without notice, for any reason, including but not limited to:

•Violation of these Terms of Use
•Fraudulent, abusive, or illegal activity
•Prolonged inactivity
•Upon your request

Upon termination, your right to use the platform will immediately cease. Provisions that by their nature should survive termination (including disclaimers, indemnification, and limitations of liability) will remain in effect.

9. Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Arbitration: For disputes involving amounts less than ₹5,00,000, you agree to first attempt resolution through good faith negotiation. If unresolved within 30 days, disputes shall be settled through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

10. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting the updated terms on our platform with a new "Last Updated" date.

Your continued use of the platform after such modifications constitutes your acceptance of the updated terms. If you do not agree to the modified terms, you must discontinue use of the platform.

We encourage you to review these terms periodically to stay informed of any changes.

11. Miscellaneous

Entire Agreement: These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and DweLL In regarding use of the platform.

Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these terms without our prior written consent. We may assign our rights and obligations without restriction.

Third-Party Rights: These terms do not create any third-party beneficiary rights.
